Muigai Commercial Agencies Ltd. provides real estate agency, property management, building and property valuation, property development and project management services.

2. Information we collect

General enquiries

When you use the Contact page, we may collect your name, email address, telephone number, enquiry type, message, consent confirmation, enquiry source and the date and time of the enquiry.

You must provide at least one contact method so that we can respond to you.

Property enquiries

When you enquire about a published property, we may collect your name, email address, telephone number, enquiry message and consent confirmation.

We also retain the relevant property's internal identifier, title, reference and website address so that the enquiry remains connected to the correct listing.

Website contact interactions

The website may record limited interaction information when certain contact controls are used, such as the contact channel, website surface, time of interaction and relevant property context where applicable.

These interaction records are intended to help MCA understand how website visitors choose to make contact. They are not designed to store the contents of your telephone or WhatsApp conversation.

Security information

Limited technical information, including network information such as an IP address, may be processed temporarily to protect enquiry forms against spam, automated submissions and abuse.

3. Why we use your information

We use personal information submitted through the website only for purposes connected with the interaction for which it was supplied. These purposes include:

  • responding to your general enquiry;
  • responding to an enquiry about a particular property;
  • contacting you using the contact method you provide;
  • maintaining appropriate records of enquiries and responses;
  • protecting the website and its forms from spam, fraud and automated abuse; and
  • understanding, at a limited operational level, which website contact channels are being used.

We do not use the enquiry-form consent checkbox as permission to add you automatically to a marketing mailing list.

4. Our basis for processing

Where you submit an enquiry and ask MCA to contact you, we process the information you provide for the purpose of responding to that request. The forms also ask you to confirm that MCA may contact you about your enquiry.

We also process limited technical information where necessary to operate, secure and protect the website and its public enquiry facilities.

5. Google reCAPTCHA

The General Enquiry form and Property Enquiry form use Google reCAPTCHA v2 to help distinguish legitimate visitors from automated abuse.

When reCAPTCHA is used, Google may process technical information associated with the request. The website sends the reCAPTCHA response to Google's verification service before an enquiry is accepted.

MCA does not store the reCAPTCHA response token as part of the enquiry record.

Google's processing is subject to the Google Privacy Policy and Google Terms of Service .

6. Cookies and similar technologies

This website currently does not use advertising cookies or website analytics cookies on its ordinary public pages.

Google reCAPTCHA is loaded only where its form-security service is required. Google states that reCAPTCHA uses the necessary _GRECAPTCHA cookie for risk analysis.

WordPress may also use cookies for authorised staff login and administration. Those administrative cookies are not used to advertise to ordinary website visitors.

You can control or block cookies through your browser settings. Blocking cookies required by reCAPTCHA may prevent the protected enquiry forms from working correctly. If you do not wish to use a protected form, you may contact MCA directly by telephone, email or WhatsApp instead.

If MCA later introduces analytics, advertising or other non-essential tracking technologies, this notice and the website's cookie controls will be reviewed before those technologies are used publicly.

7. Who may receive your information

Website enquiry information may be accessed by authorised MCA personnel who need it to respond to or manage the enquiry.

MCA may also rely on technical service providers that support website hosting, email delivery, security and form protection. Google receives the information required to perform reCAPTCHA verification when you use a protected form.

Information may also be disclosed where disclosure is required by applicable law, regulation or a lawful request from a competent authority.

8. International processing

Some third-party technology providers used by the website, including Google, operate internationally. Information processed through those services may therefore be handled on infrastructure outside Kenya.

MCA will take reasonable steps to use service providers and processing arrangements that provide appropriate safeguards for personal information.

9. How we protect information

MCA applies technical and organisational safeguards appropriate to the website's enquiry functions. Current measures include HTTPS, restricted administrative access, private enquiry records, server-side input validation, anti-spam controls, rate limiting and server-side reCAPTCHA verification.

No internet service can promise absolute security. We therefore review website security and access controls as the service develops.

10. How long we keep information

MCA keeps personal information only for as long as reasonably necessary for the purpose for which it was collected, including responding to and following up an enquiry, maintaining appropriate business records, complying with legal obligations and resolving disputes.

Enquiry records should be reviewed periodically and securely deleted or anonymised when they are no longer required, subject to any applicable legal or business record-keeping requirement.

11. Your data-protection rights

Subject to applicable law, you may have rights relating to personal information held about you, including the right to:

  • be informed about how your personal information is used;
  • request access to personal information held about you;
  • object to certain processing;
  • request correction of false, inaccurate or misleading information; and
  • request deletion where the applicable legal conditions are met.
